Mr. James Tully asked the Minister for Labour if any proceedings in the High Court have been instituted in relation to the interpretation of section 7 or any other section of the Redundancy Payments Act, 1967; and, if so, if he will give a summary of the legal dispute. Hillery Minister for Labour (Dr. Hillery): The only such proceedings that I am aware of relate to an appeal by an employer on a point of law arising from a decision of the Redundancy Appeals Tribunal. As this case is sub judice it would not be proper for me to comment on it. Mr. James Tully Mr. James Tully Mr. James Tully: May I assume the section will be operated as in the Act until such time as the decision is given on it? Dr. Hillery Dr. Hillery Dr. Hillery: I do not think I could comment on that without a clear question. The section of the Act involved in reference to the High Court is section 40 which provides that, on the request of the Tribunal, the Minister may have a case referred to it except on a question of weekly payments, or if the Tribunal makes a decision one or other of the people involved may appeal to the High Court.
