34. Mr. James Tully asked the Minister for Labour if any proceedings in the High Court have been instituted in relation to the interpretation of section 7 or any other section of the Redundancy Payments Act, 1967; and, if so, if he will give a summary of the legal dispute.

Minister for Labour (Dr. Hillery): The only such proceedings that I am aware of relate to an appeal by an employer on a point of law arising from a decision of the Redundancy Appeals Tribunal. As this case is sub judice it would not be proper for me to comment on it.

Mr. James Tully: May I assume the section will be operated as in the Act until such time as the decision is given on it?

Dr. Hillery: I do not think I could comment on that without a clear question. The section of the Act involved in reference to the High Court is section 40 which provides that, on the request of the Tribunal, the Minister may have a case referred to it except on a question of weekly payments, or if the Tribunal makes a decision one or other of the people involved may appeal to the High Court. This is what happened in this case and, as it is before the Court, I am not in a position to comment on it.
