[932] Mr. Moore asked the Minister for Justice whether he will state how many prosecutions have taken place up to the present for breaches of Section 11, sub-section (3) of the Weights and Measures Act, 1928; and whether he will state particulars of the fines imposed in such cases where an offence was proved.

Minister for Justice (Mr. Fitzgerald-Kenney): Up to the present there has been only one prosecution under Section 11, sub-section (3) of the Weights and Measures Act, 1928. The offence was proved and a fine of 10s. was imposed.

Mr. Moore: Am I to understand, then, that this Act is not being enforced? Surely the Minister must be aware that there are scores of offences under the Act being committed every day?

Mr. Fitzgerald-Kenney: I am not aware of that.

Mr. Moore: That is an extraordinary statement.

Mr. Fitzgerald-Kenney: If the Deputy is aware of it, perhaps he would give me information.

Mr. Moore: I can do so. I can give you plenty of instances of it.
