Debate resumed on amendment 38:— “In the second column, opposite the word `hares' in the first column, to delete the word `April' and substitute the word `March.' —Richard S. Anthony, Denis J. Ruttledge.” Mr. Gorey Mr. Gorey Mr. Gorey: I think amendments 38, 39, 41 and 42 have been more or less disposed of as a result of the understanding arrived at by the Minister on Friday last. Minister for Justice (Mr. Fitzgerald-Kenney) James Fitzgerald-Kenney 437 [437] Minister for Justice (Mr. Fitzgerald-Kenney): On Friday last I intimated my willingness to accept the 1st March as the close season for hares, and I suggested that Deputy Anthony and Deputy Gorey might put their heads together for the purpose of drafting an amendment and making clear what they wished to be done with reference to authorised coursing meetings and bring forward that amendment on the Report Stage. Amendment 38 agreed to. Mr. Shaw Mr. Shaw Mr. Shaw: I move: “In the second column, opposite the word `hares' in the first column, to delete the words and figures `30th day of September' and substitute the words and figures `25th day of September.' ” This amendment is brought forward at the request of the Irish Coursing Club, and I hope the Minister will accept it. Mr. Fitzgerald-Kenney Mr. Fitzgerald-Kenney Mr. Fitzgerald-Kenney: As this is only a matter of five days, I will accept the amendment. 438 [438] Amendment agreed to. Mr. O'Mahony Mr. O'Mahony Mr. O'Mahony: I have put down the following amendment: “At the end of the schedule to insert in the appropriate columns the words:—Landrail—From the 1st day of February to the 1st day of September, both days inclusive.” I would like to withdraw this amendment so that I may bring up on the Report Stage an amendment instead changing the dates given to 1st March and 11th August. Amendment not moved. Mr. Gorey Mr. Gorey Mr. Gorey: Has landrail always been accepted as game? Mr. Fitzgerald-Kenney Mr. Fitzgerald-Kenney Mr. Fitzgerald-Kenney: Yes. Mr. Gorey Mr. Gorey Mr. Gorey: It is not considered to be a game bird and very few people treat it as such. I see no necessity for it being so treated. Mr. Fitzgerald-Kenney Mr. Fitzgerald-Kenney Mr. Fitzgerald-Kenney: I move: “In Part I, in the last line of the first column to delete the figures `27' and substitute the figures `37.' ” By a mistake the figure 27 was written instead of 37. It is merely a misprint. Amendment put and agreed to. Mr. Fitzgerald-Kenney Mr. Fitzgerald-Kenney 439 [439] Mr. Fitzgerald-Kenney: I move: “In Part I. in the third column after the words `The whole Act' opposite the words `An Act for the preservation of game' in the second column, to add the words `except Sections 10, 11, 12 and 13.' ” This amendment has the effect of keeping in force a certain part of an old Act which prevents trespass in pursuit of game—Sections 10, 11. 12 and 13. Dr. Ryan Dr. Ryan Dr. Ryan: What are the sections? Mr. Fitzgerald-Kenney Mr. Fitzgerald-Kenney 440 Mr. Fitzgerald-Kenney: They are sections which enable prosecutions [440] to be brought for trespass in pursuit of game. As the Bill stood, through an oversight, no prosecutions for trespass in pursuit of game could be brought. By leaving these sections unrepealed, prosecutions for trespass in pursuit of game can be brought. Mr. Allen Mr. Allen Mr. Allen: Will the Minister state whether rabbits will be considered game if this amendment is passed? Mr. Fitzgerald-Kenney Mr. Fitzgerald-Kenney Mr. Fitzgerald-Kenney: Yes.
